# sk166694 - CPUSE upgrade fails with "Failed to copy files from /var/log to the new partition"

## Symptoms

- * CPUSE Upgrade fails with the error:   
  "`Failed to copy files from /var/log to the new partition created by the installation.`  
  `Failed to copy /mnt/fcd/var/log to /var`"  

* The `/opt/CPInstlog/install_Major_[target version name and image].log` log file shows:  
  `cannot overwrite non-directory '/var/log/CPbackup/backups' with directory '/mnt/fcd/var/log/CPbackup/backups'`   

* The `/opt/CPInstlog/LastActionSummary.txt` log file shows:  
  `
  Reason: Failed to copy /mnt/fcd/var/log to /var`  
  `
  Time: XXX`  
  `
  Error code: MSG_MAJOR_ERROR_FAILED_VAR_LOG_COPY`

## Cause

The folder */var/log/CPbackup/backups* is missing.  
This may be due to it being missing completely, being replaced by a soft-link, a file with an identical name, and so on.
